1. Our approach
1.1. OTWONO Enterprises LLC (“OTWONO”, “we”, “us” or “our”) respects the intellectual property of others and expects users of www.otwono.com and otwonostudios.com (the “Sites”) to do the same.
1.2. We respond to clear notices of alleged copyright infringement that follow the US Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
1.3. This policy covers material that users post on the Sites (such as profiles, photos and posts). If you believe OTWONO’s own content infringes your rights, please contact us at billing@otwonostudios.com and we will look into it.
2. Designated copyright agent
Send copyright notices to our designated agent:
Copyright Agent, OTWONO Enterprises LLC
Email: billing@otwonostudios.com
Mailing address available on request by email.
Please put “Copyright notice” in the subject line.
3. How to report infringement (takedown notice)
3.1. Your written notice must include:
- your physical or electronic signature (typing your full legal name works for email);
- identification of the copyrighted work you say is infringed (or, if several works, a representative list);
- identification of the material you say is infringing, with enough information for us to find it, ideally the exact URL;
- your contact information: name, mailing address, phone number and email address;
- a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
3.2. Notices that leave out required information may not be acted on.
3.3. When we receive a complete notice, we will remove or disable access to the material promptly and make a reasonable effort to notify the user who posted it, including a copy of the notice.
4. How to respond if your material was removed (counter notice)
4.1. If you believe your material was removed by mistake or misidentification, or that you have the right to use it, you may send a counter notice to our designated agent.
4.2. Your counter notice must include:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
- your name, address and phone number; and
- a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which OTWONO may be found), and that you will accept service of process from the person who sent the original notice or their agent.
4.3. When we receive a valid counter notice, we will send a copy to the person who sent the original notice. We will restore the material 10 to 14 business days after receiving the counter notice, unless our designated agent first receives notice that the original complainant has filed a court action seeking to stop the user from posting the material.
5. Misrepresentations
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees. If you are not sure whether something infringes your rights, please consider getting legal advice before sending a notice.
6. Repeat infringer policy
6.1. OTWONO will, in appropriate circumstances, terminate the accounts of users who are repeat infringers.
6.2. A user is considered a repeat infringer after receiving three (3) valid takedown notices within 12 months that are not successfully resolved by counter notice. We may terminate an account sooner for clear or serious infringement.
6.3. We may also remove material or restrict accounts for infringement under our Terms of Service without receiving a formal DMCA notice.
7. OTWONO’s own content
7.1. Bad Orbit, its music, lyrics, artwork, scripts, novel, audiobook, videos and logos are OTWONO content. If you see OTWONO content being copied, sold or reuploaded without permission elsewhere, we would appreciate you telling us at billing@otwonostudios.com.
7.2. To ask permission to use OTWONO content, email billing@otwonostudios.com.
8. Changes
